I would give this a 0 star rating if I could! Stirling Ackroyd lied to the tenants and the landlord to ensure that both parties signed the contract. After the contract was signed, Stirling Ackroyd refused to be held accountable for the incorrect information they had told both parties! Another thing is that the Agency makes all of these promises verbally which they then deny ever having said! So if you do make the mistake of using Stirling Ackroyd, make sure EVERYTHING is in writing! On the viewing day, we met with the agent, Kurwahn, to view the house. It was a lovely house but came fully furnished. We made it very clear that we would like some of the furniture removed to which Kurwahn said of course that can be done through communicating with the landlord. We (the tenants) then clearly asked about the process of a tenancy swap at any point in the agreement. We were verbally told (multiple times by two agents, Kurwahn and Danielle) that a tenancy swap can take place at anytime if the tenant pays a £50 fee and finds a replacement tenant… this is also clearly written on the agreement. We later found out that the agency had told the landlord that we were wanting to sign up for a year and would probably like to renew the contract after the year is finished (we definitely did not say this)! After signing the agreement, we emailed the landlord to ask for furniture to be removed, as verbally promised by the agency, to which the landlord responded “absolutely not, all furniture is to stay where it is”. The landlord explained that she had been very clear with the agency regarding the furniture and how it could not be removed due to nil storage space. We phoned Kurwahn to explain the situation to which he responded “my only suggestion is to lie and say that you need the current mattresses to be removed due to medical reasons”. Due to extenuating circumstances (needing to move back home to Australia), I needed to do a tenancy swap 3 months into the contract. I emailed Stirling Ackroyd to explain the situation, advise them of the next tenant taking my spot and asked which account I should pay the £50 for the tenancy swap to take place. I was told by the agency that this needs to be “agreed by the landlord”. I phoned the landlord and asked if she agreed. The landlord said she would agree but the agency has asked for her to pay a £430 “administrative fee” for the change so the landlord declined for me to move out. The £430 fee was not written on either the landlord’s nor the tenants contract. The agency denied having told us (the tenants) that the tenancy swap was as easy as a £50 fee and asked me if this was in writing. I was told by the agency that if I wanted a tenancy swap to take place, I would have to come to “an agreement” with the landlord ie. I would have to pay the £50 tenant fee+ £430 landlord fee for the swap. I sought advice through Shelter and I was informed that it was illegal under the “2019 Tenancy Act” for the tenant to pay more than £50 for a swap. I passed this information to the agency to which they said they understand that the tenant shouldn’t pay more than £50 but that the landlord was not wanting to pay the £430 which meant the swap could not take place unless the tenant and landlord came to an “agreement”. I felt backed into a corner with no other option than to pay the $430 + $50 fee for the swap. Basically, save yourself the hassle, the emotional distress and save your bank account! DO NOT USE STIRLING ACKROYD!
Please put any complaint in writing, including as much details as possible. We have eight weeks to consider your complaint. If we have not resolved it within this time you may refer your complaint to The Property Ombudsman.
What will happen next?
We will send you a letter acknowledging receipt of your complaint within three working days of receiving it, enclosing a copy of this procedure.
We will then investigate your complaint. This will normally be dealt with by the department manager who will review your file and speak to the member of staff who dealt with you. A formal written outcome of our investigation will be sent to you within 15 working days of sending the acknowledgement letter.
If, at this stage, you are not satisfied, you should contact us again and we will arrange for a separate review to take place by a senior member of staff.
We will write to you within 15 working days of receiving your request for a review, confirming our final viewpoint on the matter.
If you remain dissatisfied, you can then contact The Property Ombudsman to request an independent review:
